Although a mediation is very much "the client's day", an representative with experience of the mediation process can be an important asset in helping the client to achieve a satisfactory and acceptable settlement. A basic understanding of essential negotiating techniques and terminologies, such as "anchoring", understanding "BATNAs", "WOTNAs" and "ZOPA" and the framing offers as gains to the other party rather than losses are all important factors. Lawyers, in particular, often get very bound up in the strengths and weaknesses of the legal case (an important reference point) but can find it difficult to focus back on the personal and commercial needs and interests of their client and the other parties.
